GetWardrobe Terms of Service

1. Introduction
Welcome to GetWardrobe! By accessing or using our web platform, iOS, Android, or MacOS apps, you agree to comply with and be bound by the following terms. These terms apply to all users, including visitors, registered users, and account holders. Please review them carefully.
2. Content Ownership and Licensing
Users retain ownership of the content they upload. However, by submitting content, you grant GetWardrobe a non-exclusive, royalty-free, worldwide, and irrevocable license to use, distribute, modify, and display this content solely for the duration of the service, for the purpose of operating, promoting, and improving our services. This license includes the right to sublicense the content to third parties for the same purposes and terminates upon the deletion of your account.
3. AI Credits and Virtual Currency
3.1 AI Credits Overview
GetWardrobe offers AI Credits ("Credits") as a virtual currency that can be purchased and used to access AI-powered features within our service, including but not limited to: advanced background removal, outfit recommendations, automatic categorization, and other AI-enhanced functionalities.
3.2 Purchase and Payment
- Credits may be purchased through in-app purchases or our web platform using approved payment methods.
- All Credit purchases are final and non-refundable except as required by applicable law or as specifically stated in these terms.
- Prices for Credits are displayed at the time of purchase and may change at our discretion with reasonable notice.
- Payment processing is handled through third-party payment processors subject to their terms and conditions.
3.3 Credit Usage and Limitations
- Credits are consumed when you use AI-powered features. The cost in Credits for each feature is displayed before use.
- Credits are non-transferable and may not be sold, traded, or exchanged for cash or other value.
- We reserve the right to modify Credit pricing for features without advance notice.
- Fair use policies apply to prevent abuse. Excessive or automated usage may result in restrictions or account suspension.
3.4 Credit Expiration
- Credits purchased do not expire unless your account is terminated or closed.
- Credits granted as part of subscription will expire with subscription.
- We will provide at least 90 days' notice before implementing any expiration policy for existing Credits.
- Promotional or bonus Credits may have specific expiration dates communicated at the time of issuance.
3.5 Refunds
- Credit purchases are generally non-refundable.
- Refunds may be issued at our sole discretion in cases of technical errors, unauthorized transactions, or as required by law.
- Refund requests must be submitted within 10 days of purchase to support@getwardrobe.com.
- If a refund is granted, any Credits granted from that purchase will be deducted from your account.
3.6 Account Termination and Credits
- Upon voluntary account closure, unused Credits will be forfeited unless required otherwise by law.
- If we terminate your account for Terms of Service violations, all Credits will be forfeited without refund.
- You may request a refund for unused Credits purchased within the previous 90 days if we terminate your account without cause.
3.7 Service Changes
- We reserve the right to modify, suspend, or discontinue AI features or the Credit system with 30 days' notice.
- In case of service discontinuation, we will provide options to use remaining Credits or obtain refunds for Credits purchased within the prior 180 days.
3.8 Credits and Professional Use
- All account types (free, Premium, and Stylist Pro) can purchase and use AI Credits to access AI-powered features.
- Professional stylists may use Credits to process their own wardrobe content and client content (when granted access by Premium clients).
- Credits purchased on any account type can be used for professional styling activities within the permitted commercial use guidelines.
- Fair use policies apply: Excessive bulk processing, automated usage, or patterns indicating use beyond personal styling services may require enterprise licensing.
- Professional stylists are responsible for ensuring they have appropriate rights and permissions to upload and process client content.
- Client data must be handled in compliance with applicable privacy laws and our Privacy Policy.
4. User Conduct and Community Guidelines
To maintain a safe, respectful, and functional community, users agree not to engage in prohibited activities, including but not limited to:
4.1 Content Prohibitions
- Uploading content that infringes on intellectual property rights, including copyrighted images, trademarks, or designs.
- Uploading, distributing, or processing pornographic, sexually explicit, or adult content of any kind.
- Uploading images of minors without proper parental consent, or any content that sexualizes, exploits, or endangers minors.
- Uploading violent, graphic, or disturbing content, including content depicting harm to people or animals.
- Uploading content that promotes or glorifies illegal activities, terrorism, or dangerous organizations.
- Uploading content containing hate speech, discriminatory material, or content that promotes violence or hatred against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
- Using AI features to create, generate, or process deepfakes, manipulated images intended to deceive, or non-consensual intimate imagery.
- Uploading content that violates any person's privacy rights or right to publicity without proper authorization.
4.2 Platform Misuse
- Distributing malware, viruses, or any malicious code.
- Engaging in spamming, phishing, or any fraudulent activities.
- Misusing the platform or engaging in activities that could harm the service, its infrastructure, or other users.
- Using automated tools, bots, or scripts to scrape website content, create accounts, or interact with the service without authorization.
- Using automation to overload the service (DDoS attacks) or otherwise disrupt service availability.
- Attempting to gain unauthorized access to other users' accounts, our systems, or any part of our service.
- Reverse engineering, decompiling, or attempting to extract source code or algorithms from our services or AI features.
- Circumventing any security measures, access controls, or usage limitations we implement.
4.3 AI Credits and Feature Abuse
- Attempting to manipulate, exploit, or circumvent the AI Credits system.
- Purchasing Credits using fraudulent payment methods or stolen payment information.
- Creating multiple accounts to obtain promotional Credits or circumvent usage limitations.
- Sharing, selling, or transferring Credits or account access to third parties.
- Using AI features for illegal purposes or to generate prohibited content.
- Excessive or abusive use of AI features designed to deplete resources or degrade service for others.
4.4 Community Conduct
- Engaging in harassment, bullying, stalking, or threatening behavior toward other users.
- Impersonating another person, brand, or entity, or falsely claiming affiliation with any person or organization.
- Creating fake accounts or using misleading information to deceive other users.
- Engaging in any form of coordinated manipulation, including fake engagement or artificial inflation of metrics.
- Sending unsolicited commercial messages or using the platform for unauthorized advertising.
- Attempting to solicit personal information from other users, especially minors, for inappropriate purposes.
4.5 Additional Prohibitions
- Using the service in any way that violates local, state, national, or international laws or regulations.
- Uploading content that you do not have the legal right to upload, share, or process.
- Interfering with or disrupting other users' enjoyment of the service.
- Using the service to facilitate, encourage, or engage in illegal marketplace activities.
4.6 Enforcement
Violation of these guidelines may result in:
- Warning notices
- Temporary restrictions on specific features
- Temporary account suspension
- Permanent account termination
- Forfeiture of unused AI Credits without refund
- Reporting to appropriate law enforcement authorities where illegal activity is suspected
We reserve the right to investigate suspected violations and cooperate with law enforcement authorities. We may preserve and disclose user information if required by law or if we believe in good faith that such preservation or disclosure is reasonably necessary to comply with legal process, enforce these Terms, or protect the rights, property, or safety of GetWardrobe, our users, or the public.
Users may appeal a termination decision by writing to support@getwardrobe.com within 30 days of the termination notice. Appeals will be reviewed within 30 days, and our decision on the appeal will be final.
5. GetWardrobe Intellectual Property Rights
All rights, title, and interest in and to the GetWardrobe services, including our web platform, iOS, Android, and MacOS apps, our website, logos, trademarks, and the underlying software, technology, and content (excluding user-uploaded content), are and will remain the exclusive property of GetWardrobe and its licensors. Our services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Nothing in these Terms gives you a right to use the GetWardrobe name or any of the GetWardrobe trademarks, logos, domain names, and other distinctive brand features without our prior written consent.
6. Disclaimer of Warranties
THE GETWARDROBE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GETWARDROBE, ITS AFFILIATES, AND ITS PARTNERS MAKE NO WARRANTIES, EITHER EXPRESS OR IMPLIED, ABOUT THE SERVICES. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE ACCURATE, RELIABLE, UNINTERRUPTED, OR ERROR-FREE. WE DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GETWARDROBE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL GETWARDROBE'S AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID GETWARDROBE, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.
8. Commercial and Professional Use
8.1 Permitted Commercial Use
GetWardrobe welcomes professional stylists, fashion consultants, and personal shoppers to use our platform for their business needs.
8.2 For Professional Stylists
You may use GetWardrobe with a free, Premium, or Stylist Pro account to provide professional styling services to your clients.
Stylist Pro subscription is recommended for professional use as it includes enhanced features specifically designed for stylists, including:
- Dedicated client management tools
- Professional styling advice sections
- Streamlined client onboarding and invitation features
- Premium features for all your clients (included in Stylist Pro)
- Enhanced collaboration and wardrobe access tools
8.3 Client Requirements
- For clients to share wardrobe access with you (their stylist), they must have an active Premium subscription.
- Clients without Premium can still use GetWardrobe but cannot grant wardrobe access to stylists.
- This ensures both you and your clients have the best tools and features for professional collaboration.
8.4 Professional Use Guidelines
- Ensure you have appropriate consent and rights to upload and manage client images and content.
- Respect client privacy and comply with applicable data protection obligations.
- Use AI features appropriately when processing client content.
- Maintain professional standards when using the platform for client services.
8.5 Prohibited Commercial Use
The following commercial activities are prohibited without express written authorization:
- Reselling, redistributing, or white-labeling our services to third parties as your own product.
- Using our AI features for bulk commercial processing unrelated to personal styling (e.g., processing inventory for retail stores, wholesale operations, or mass production workflows).
- Integrating our API or services into third-party commercial applications without a business partnership agreement.
- Using the platform for e-commerce, retail inventory management, or wholesale operations as a primary business function.
- Data mining, scraping, or extracting content for commercial databases, competitive services, or resale.
- Using Credits or AI features to create competing wardrobe management services or products.
- Mass commercial advertising or promotional activities beyond reasonable promotion of your personal styling services.
8.6 Enterprise and High-Volume Use
If your business requires:
- Processing wardrobes for more than 20 clients simultaneously
- Bulk processing of retail inventory
- API access or custom integrations
- White-label solutions

Unauthorized commercial use beyond the scope described above may result in account restrictions, termination, and forfeiture of any remaining AI Credits.
9. Data Security and Privacy Commitment
We implement industry-standard security measures to protect your data, including encryption, secure payment processing, and regular security audits. We are committed to user privacy and handle personal data in accordance with our Privacy Policy, which outlines how we collect, use, and protect your information. We comply with relevant data protection laws, such as GDPR and CCPA. Users have the right to access, correct, or delete their information.
10. AI Services and Limitations
10.1 AI Service Accuracy
- AI-powered features are provided on an "as-is" basis and may not always produce perfect or expected results.
- We do not guarantee the accuracy, reliability, or appropriateness of AI-generated recommendations or outputs.
- You are solely responsible for reviewing and using AI-generated content and recommendations.
10.2 AI Content Processing
- By using AI features, you consent to your uploaded content being processed by AI systems, which may include third-party AI service providers.
- We retain the right to use AI-processed content to improve our services and AI models, subject to our Privacy Policy.
- AI processing occurs on secure servers, but you acknowledge that no system is completely secure.
11. Termination of Service
GetWardrobe reserves the right to terminate or suspend your account for violations of these terms or other conduct deemed inappropriate. Upon termination, access to your account and data will be disabled, and we may permanently delete your data and content from our systems. Unused AI Credits will be handled according to Section 3.6. We will provide notice of termination at least 30 days in advance, where possible. Users may appeal a termination decision by writing to support@getwardrobe.com within 30 days of the termination notice.
12. Dispute Resolution
By using our web or mobile applications, you agree that any dispute, claim, or controversy arising out of or relating to these Terms of Service, your use of the application, or any related services (including disputes related to AI Credits purchases or usage) (collectively, "Disputes") shall be resolved exclusively through binding arbitration, rather than in court.
The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (www.adr.org) in effect at the time of the arbitration. The arbitration shall take place in Chicago, Illinois, unless the parties agree otherwise in writing.
You agree that any arbitration shall be conducted on an individual basis and not as a class, collective, or representative action. You waive any right to a jury trial or to participate in a class action.
You may opt-out of this arbitration agreement by providing written notice to us at support@getwardrobe.com within 30 days of your acceptance of these Terms of Service. Your notice must include your name, address, and a statement that you wish to opt-out of the arbitration agreement.
Each party will bear its own costs of arbitration unless otherwise required by law.
13. Modification of Terms
GetWardrobe may update these terms from time to time. We will notify you of significant changes via email or through our apps. Continued use of our services after changes indicates your acceptance of the new terms. If you do not agree with the changes, you must discontinue using the services.
14. Third-Party Services
Our services may integrate with third-party services, such as payment processors, AI service providers, and analytics providers. By using our services, you agree to the terms and conditions of these third-party services, which are governed by their respective privacy policies. GetWardrobe is not responsible for the actions or policies of these third-party services. Users are responsible for reviewing and agreeing to the terms of third-party services.

16. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any legal actions or proceedings arising out of these terms will be brought exclusively in the courts located in Illinois.
